Terms & Conditions outline the guidelines, responsibilities, and expectations for working together. They are designed to ensure clarity, transparency, and a smooth experience for both parties before, during, and after each project.

Terms & Conditions

1. General

By booking a service, consultation, or appointment, the client agrees to the following Terms of Service. These terms apply to all services provided by Charles Dube (aka Charles Raziel) unless otherwise agreed in writing. All materials are the intellectual property of the client and may be used for personal promotion without the client's consent, unless explicitly agreed upon by both parties. No usage rights or licenses to the deliverables transfer to the client until full and final payment has been received by the videographer.

In the event of a breach of contract by the client, the client relinquishes all rights to the deliverables and may incur penalty fees or be disqualified from future engagements.

The final agreed price, shoot location, date, delivery dates, and specific promotional scope discussed via written communication (including email, booking forms, or direct messaging) are hereby incorporated into this contract as the 'Project Specification'.

2. Services

Services may include consultation, planning, filming, editing, and color grading, as described on the website or agreed upon before the shoot. The exact scope of each project is discussed and agreed upon before filming. Any additional requests outside the agreed scope may require additional fees.

3. Booking & Payment

Bookings are only secured upon receipt of a non-refundable booking deposit of (20%) of the total project fee. The remaining balance must be paid in full either in person immediately following the session or before the delivery of the final unwatermarked deliverables, as specified in the Project Specification. No usage rights or licenses to the final videos transfer to the client until full and final payment has been received.

Failure to complete payment as agreed will result in withheld delivery of final materials.

4. Cancellations & Rescheduling

Clients are requested to provide at least 24 hours’ notice for cancellations or rescheduling. Late cancellations or no-shows may be subject to a cancellation fee, no refund, or refusal of future bookings. If the videographer must cancel due to unforeseen circumstances, the client will be offered a rescheduled date or a full refund of any paid fees.

5. Clients are responsible for:

1) Arriving on time and prepared.

2) Ensuring access to the agreed location.

3) Securing any necessary permissions or permits for filming.

4) Informing the videographer of any special requirements in advance.

5) Delays caused by the client may reduce available shooting time and do not entitle the client to additional time or compensation.

6. Creative Direction & Expectations

While client input and references are welcome, the final artistic decisions regarding filming, editing, and color grading remain at the discretion of the videographer. By booking a service, the client acknowledges that artistic interpretation is subjective and agrees that minor differences in style or preference do not constitute grounds for refunds.

7. Revisions

The base project fee includes 2 rounds of minor revisions. All revision requests must be submitted in writing within 3 business days of the initial delivery. Requests made after this period will be billed at an additional hourly rate.

8. Delivery

Estimated delivery timelines will be provided in writing. While every effort is made to meet deadlines, delivery dates are estimates, and the videographer is not liable for minor delays due to workload or unforeseen technical complexities or real-world emergencies. Raw footage is not included unless explicitly agreed in writing (it will be billed as a separate cost).

9. Usage Rights

Unless otherwise agreed in writing, the client receives a limited license to use the final delivered video solely for the specific promotional event or campaign detailed in this agreement.

Any extended use, including but not limited to paid advertising campaigns, multi-year marketing, or third-party distribution, constitutes commercial usage and requires an additional, separate licensing fee. The videographer retains all copyright ownership and the right to use the work for self-promotion, portfolio display, and social media.

Clients are strictly prohibited from publishing, sharing, or displaying watermarked review drafts. Clients may not alter, re-edit, crop, or apply filters to the final delivered video without written consent. 10. Liability:

To the maximum extent permitted under Czech law, the videographer’s total liability for any claim, loss, or damage shall not exceed the total amount paid by the client for the specific service. Act No. 89/2012 Coll., Civil Code.

Om the unlikely event of equipment failure or data loss, liability is strictly limited to a reshoot or a refund of the paid service.

11. Safety & Conduct

A respectful, professional working environment is expected at all times. The videographer reserves the right to terminate a session immediately if a client behaves inappropriately, unsafely, or disrespectfully. In such cases, no refund will be issued.

12. Privacy

Client information is handled with care and used solely for communication and service delivery. Personal data will not be shared with third parties without consent.

13. Governing Law

These Terms of Service are governed by the laws of the Czech Republic.

14. Acceptance

By booking a service or appointment, the client confirms that they have read, understood, and agreed to these Terms of Service.
